Terms of Service
Effective October 20, 2026. These terms are an agreement between you and Jack Schulz, doing business as wxdeck (“wxdeck”, “we”, “us”), an individual based in Indiana, and they govern your use of wxdeck.com and everything served from it (the “Service”).
1. Weather information: read this first
The radar, satellite imagery, forecasts, alerts and observations on wxdeck are republished from government and third-party sources and then processed by us. They can be late, incomplete, reprojected, recoloured, blended or simply wrong. Forecasts are model output and carry real uncertainty. The full Weather Data Disclaimer is part of these terms.
2. Accepting these terms
By signing in or otherwise using the Service, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Service.
3. Who can use the Service
- You must be at least 18 years old, or the age of majority where you live if that is higher, to create an account.
- The Service is not directed to children. We do not knowingly allow anyone under 13 to use it or collect their personal information. See the Privacy Policy’s children section.
- The Service is offered to people in the United States. You may not use it if you are barred from receiving services under US law, including US sanctions.
4. Your account
You sign in with your Google account. Google shares your name, email address, profile picture and the identifier it uses for your account with us, and nothing else from your Google account. You are responsible for keeping that Google account secure, and for everything that happens under your wxdeck account. One account is for one person; do not share it. Tell us at support@wxdeck.com if you think someone else has used it.
You can download a copy of your account data, or delete your account, at any time at /account.
5. Price
wxdeck is free during its beta. If paid plans are introduced, these terms and the privacy policy will be updated before anyone is charged.
6. Acceptable use
You agree not to:
- scrape, crawl, or bulk-download the Service or its data, or access it by automated means, without our written permission;
- resell, sublicense, rebroadcast or frame the Service or its output, or sell access to your account;
- get around rate limits, access controls or security measures, or probe them for weaknesses without our written permission;
- interfere with the Service or its infrastructure, or overload the upstream sources it relies on;
- present anything from wxdeck as an official government warning or forecast, or as endorsed by NOAA or the National Weather Service;
- use the Service for anything unlawful.
We may suspend access that breaks these rules, and may block traffic that looks automated.
7. Who owns what
- Ours. The wxdeck software, design, text, name and logo, and our own methods — including how we blend forecast models and how we compute snow ratios — belong to us or our licensors. These terms give you a personal, non-transferable, revocable right to use the Service as offered while you comply with them, and nothing more.
- Public-domain government data. Much of the underlying data comes from US government agencies such as NOAA and the National Weather Service and is in the public domain. We do not claim copyright in that data.
- Openly licensed data. Some data and map tiles are licensed to us under open licences such as Creative Commons Attribution 4.0 and the Open Database License. Those licences, and the attribution they require, are listed on the Credits page and apply to that material in place of these terms.
- Yours. You keep any rights you have in what you put into the Service, such as a saved location’s name. You let us store and use it only to run the Service for you.
- Feedback. If you send us ideas or suggestions, we may use them without paying you or owing you anything.
If you believe something on wxdeck infringes your copyright, email legal@wxdeck.com with the details.
8. No warranty
The Service and all weather information in it are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, timeliness and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, or that any forecast, alert or observation is correct, complete or current.
Some states do not allow some of these exclusions, so some of them may not apply to you. In that case they apply to the fullest extent the law allows.
9. Limits on our liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, property damage, personal injury or business interruption, arising from or related to the Service or any weather information in it, even if we were told they were possible. Our total liability for all claims relating to the Service is limited to the amount you paid us for the Service in the 12 months before the event that gave rise to the claim.
Some states do not allow these limits, so they may not apply to you in full. Nothing in these terms limits liability that cannot be limited by law.
10. Indemnity
If someone brings a claim against us because you broke these terms or the law while using the Service, you agree to cover our reasonable costs of that claim, including reasonable attorneys’ fees, to the extent the law allows.
11. Ending this agreement
You can stop using the Service and delete your account at any time at /account. We may suspend or close your account if you break these terms, if the law requires it, or if we stop offering the Service. Sections 1 and 7 to 15 survive the end of this agreement.
12. Changes to the Service
Weather data sources change, and so will the Service. We may add, change or remove features and data sources.
13. Governing law, courts and disputes
These terms are governed by the laws of the State of Indiana and applicable US federal law, without regard to conflict-of-law rules.
If you have a problem with the Service, please email legal@wxdeck.com first; most things can be sorted out that way. Any dispute between you and us that is not resolved informally will be decided by the state or federal courts located in Hamilton County, Indiana, and you and we consent to their jurisdiction. Each of us keeps every right the law gives it. We will update these terms, as section 14 describes, before any other way of resolving disputes is ever added.
14. Changes to these terms
We may update these terms. If a change is material we will tell you at least 30 days before it takes effect, by email to the address on your account or by a notice on the site. The date at the top of this page always shows the latest version. If you keep using the Service after a change takes effect, the new terms apply; if you do not agree, stop using the Service and delete your account.
15. General
These terms, the Privacy Policy and the documents they link to are the whole agreement between us about the Service. If a court finds part of them unenforceable, the rest still applies. Our not enforcing a term is not a waiver of it. You may not transfer these terms; we may transfer them to a company that takes over the Service, including a company we form to run it. Neither of us is responsible for delays caused by events outside our reasonable control — which, for a weather service, includes the weather and outages at the agencies we rely on.
